San Diego Judge Denies Indoor Operations for Restaurant and Gym Owners

A San Diego Superior Court Judge denied the request by a group of local restaurant and gym owners who filed a lawsuit to enact a temporary restraining order that would override the California's tiered COVID-19 health system and allow them to operate indoors.

The group said that the state's tier system, which prohibits them from operating indoors is based on outdated science. However, the judge said the impact on public health outweighs the economic harm these businesses experience and that Governor Newsom is within his realm of authority to shut down businesses while the California Emergency Services Act is in effect.

The outcome of the lawsuit has not been finalized and another hearing is expected to take place in January or February of 2021.
